SAN ANGELO, TX — Enis Gutierrez Jr. has filed a lawsuit alleging he suffered severe injuries, including a severed finger, when his motorcycle collided with a Caterpillar wheel loader on Duckworth Road in October 2024.
Gutierrez filed the original petition March 31, 2025, in the 51st Judicial District Court in Tom Green County. The suit seeks more than $250,000 in damages and names driver Alexandro Saavedra, P & L Service and Repair, P & L Repair Service and Trucking LLC and Hipolito Ramirez as defendants.
According to the petition, Gutierrez was riding his motorcycle southbound on Duckworth Road in the early morning hours when Saavedra was operating the wheel loader in the same direction. The loader had two white lights to the rear, two white lights to the front and no other reflective markings or placards, the document states.
Gutierrez believed the loader was traveling toward him in its own lane, the petition says. However, he soon realized the vehicles were moving in the same direction in the same lane, leading him to take evasive action. During the evasive action, Gutierrez clipped the back of the loader, entered a ditch and struck a mailbox.
The petition alleges negligence by Saavedra, including improper lighting in violation of Texas Transportation Code sections on vehicle lights and reflectors. It claims the other defendants are liable under respondeat superior and for negligent hiring, supervision, training, retention and entrustment of the vehicle.
In a June 2025 original answer, the defendants generally denied all allegations.
A jury trial is scheduled for 8 a.m. Oct. 5, 2026, before Judge Carmen Dusek.
