Florida Company Sues Tom Green County

 

SAN ANGELO, TX — A Tampa, Florida-based technology firm is suing Tom Green County, alleging the county breached a 2023 contract by failing to pay for services and goods provided.

MCS of Tampa, Inc., which specializes in communications and information technology solutions, filed the lawsuit in September 2025 in the 119th District Court. 

The company seeks damages not exceeding $250,000, including the balance due, costs from delays or changing orders, attorney's fees and interest. 

According to the original petition, the parties entered a contract around June 2023 for work performed in Tom Green County for the county's benefit. 

Tom Green County responded in December 2025 with a plea to the jurisdiction, arguing the case should be dismissed because MCS did not first present its claim to the commissioners court, as required under Section 89.004 of the Texas Local Government Code. The county also claimed specifics weren't provided in the lawsuit about the details of the contract or the alleged breach of said contract.

District Judge Gonzalo Rios signed an order Jan. 8 setting a hearing on the county's plea for 9 a.m. Friday, Jan. 23.
